Any construction site that disturbs one or more acres, or is part of a Larger Common Plan of Development as regulated under the Texas Commission on Environmental Quality (TCEQ) Construction General Permit No. TXR150000, is required to develop a SWPPP and obtain permit coverage.

How to navigate SWPPP requirements in San Antonio

  • 1. Develop a Stormwater Pollution Prevention Plan (SWPPP)
  • 2. Prepare your TCEQ TXR150000 authorization by completing either a Small Site Notice or a Notice of Intent application, and submit it to the San Antonio Water System (SAWS) at least 48 hours prior to starting work.
  • 3. Implement your SWPPP by installing the proposed erosion and sediment controls, and ensure that all required TCEQ notices are posted.
  • 4. Conduct the required inspections and perform maintenance on any deficiency items found during the inspections.

How to navigate SWPPP requirements in Bexar County

  • 1. Develop a Stormwater Pollution Prevention Plan (SWPPP)
  • 2. Prepare your TCEQ TXR150000 authorization by completing a Small Site Notice or Notice of Intent application and Storm Water Quality Site Development Permit Application.
  • 3. Submit a copy of your SWPPP, Notice of Intent, and Storm Water Quality Site Development Permit Application to the Bexar County Public Works Storm Water Quality Division
  • 4. After your Bexar County permits are approved, implement your SWPPP by installing the proposed erosion and sediment controls, and ensure all required TCEQ and Bexar County notices are posted.
  • 5. Conduct the required inspection and perform maintenance on any deficiency items found during the inspection.

Frequently Asked Questions for San Antonio and Bexar County

A construction activity is part of a larger common plan of development if it is completed in one or more of the following ways:
  • in separate stages
  • in separate phases
  • in combination with other construction activities
It is identified by the documentation that identifies the scope of the project including such things as the following:
  • plats
  • blueprints
  • marketing plans
  • contracts
  • building permits
  • public notice or hearing
  • zoning requests

It can include one operator or many operators.

Example: A subdivision is being developed. You are building homes on 2 acres, another company is clearing 3 acres in the next phase, and a contractor is excavating another 0.5 acres for a pond. In this case, the total area that would be disturbed is 5.5 acres. As a result, each operator would be subject to the requirements associated with disturbing 5 or more acres.

“Construction” refers to actions that result in a disturbance of the land, including clearing, grading, excavating, and other similar activities.

It also includes “construction-related activities,” areas that support the construction project such as stockpiles, borrow areas, concrete truck washouts, fueling areas, material storage areas and equipment storage areas. Construction activities that do not disturb land, such as interior remodeling, generally do not require TPDES or NPDES permit coverage.
